I am writing to make a formal complaint regarding a very disturbing experience my wife and I had at The Cheesecake Factory in Austin, Texas, on the morning of August 12, 2026. When we arrived, the restaurant did not appear busy. We gave the host our phone number and were told that the wait for a table would be approximately 15–20 minutes and that we would receive a text when our table was ready. While we waited, we began noticing that other customers who arrived after us were being called and seated ahead of us. What made this especially concerning was that my wife and I were the only Hispanic couple waiting in that area, while the customers being called and seated ahead of us were white. After waiting and never receiving a text, I finally went back to the host stand and asked what was happening. The host told me that she had texted me to let me know our table was ready. I did not receive that text. I showed her my phone to demonstrate that no such message had been received. I then spoke with the manager and also showed the manager my phone. At no point had we received a notification that our table was ready. I understand that mistakes can happen. However, when customers who arrived after us were seated while we continued to wait, and we were the only Hispanic couple waiting, the situation left my wife and me with the serious concern that we were being treated differently because of our ethnicity. I am not making this complaint lightly. Being made to feel that we may have been passed over because we are Hispanic was humiliating, upsetting, and completely unacceptable. I am asking The Cheesecake Factory corporate office to formally investigate this incident. I would specifically ask that you review the restaurant's waitlist/seating records for the time we were there, determine when we were checked in, determine whether and when a text notification was actually generated or sent to my phone number, and compare our check-in and seating time with the customers who arrived after us and were seated ahead of us. If surveillance footage is available, I ask that it also be preserved and reviewed. This should not simply be dismissed as a misunderstanding. If there is an innocent explanation, I would like The Cheesecake Factory to provide it. But if we were treated differently because we are Hispanic, that is discrimination and should be addressed immediately. My wife and I came to your restaurant expecting to be treated with the same dignity, respect, and fairness as every other customer. Based on what we experienced that morning, we did not feel that we received equal treatment. I would appreciate a response from corporate management explaining what your investigation determines and what steps will be taken to ensure that every customer—regardless of race or ethnicity—is treated equally.
